These Comprehensive Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you", "User"), and the developer of Autophone ("we", "us", or "our"), an independent developer, concerning your access to and use of the Autophone mobile application, as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "App" or "Services").
PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE APP. By downloading, installing, accessing, or using the App, you agree that you have read, understood, and agreed to be bound by all of these Terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE APP AND YOU MUST DISCONTINUE USE IMMEDIATELY.
Supplemental terms and conditions or documents that may be posted in the App from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms at any time and for any reason. We will alert you about any changes by updating the "Last Updated" date of these Terms, and you waive any right to receive specific notice of each such change.
The App is strictly intended for adults who are at least 18 years old. The App is not available to, and must not be used by, anyone under the age of 18. By using the App, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms. We reserve the right to suspend or terminate any account if we have reason to believe the account holder is under the age of 18.
To access the core features of the App, you must register for an account using third-party authentication services (e.g., Google or Apple OAuth). You agree to keep your password/authentication methods confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username/nickname you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.
Autophone is a mobile application that allows users to: 1. Register vehicle license plates and associate them with their user profile. 2. Add photographs of license plates and vehicles. 3. Search for other users via their registered license plates using on-device OCR (Optical Character Recognition) camera scanning or manual text input. 4. Communicate with other users via an in-app messaging system.
We reserve the right to modify, suspend, or discontinue the Services (or any part thereof) with or without notice at any time. You agree that we will not be liable to you or to any third party for any modification, suspension, or discontinuance of the Services.
By using the App, you represent and warrant that: 1. All registration information you submit will be true, accurate, current, and complete. 2. You will maintain the accuracy of such information and promptly update such registration information as necessary. 3. You will not access the App through automated or non-human means, whether through a bot, script, or otherwise. 4. You will not use the App for any illegal or unauthorized purpose. 5. Your use of the App will not violate any applicable law or regulation.
You may not access or use the App for any purpose other than that for which we make the App available. The App may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.
As a user of the App, you agree NOT to:
The App's license-plate search and messaging features exist solely to enable lawful, respectful, and consensual communication between motorists. You expressly agree that you will NOT use these features to:
Messaging is permitted only for legitimate, good-faith reasons (for example, notifying an owner that their lights are on, their vehicle is blocking access, or is being towed). Any misuse of these features is a material breach of these Terms and may result in immediate account termination and referral to law enforcement.
The App allows you to chat, contribute to, or participate in blogs, message boards, online forums, and other functionality, and may provide you with the opportunity to create, submit, post, display, transmit, perform, publish, distribute, or broadcast content and materials to us or in the App, including but not limited to text, writings, video, audio, photographs, graphics, comments, suggestions, or personal information or other material (collectively, "Contributions").
By posting your Contributions to any part of the App, you automatically grant, and you represent and warrant that you have the right to grant, to us an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid, worldwide right, and license to host, use, copy, reproduce, disclose, publish, broadcast, retitle, archive, store, cache, publicly perform, publicly display, reformat, translate, transmit, excerpt (in whole or in part), and distribute such Contributions (including, without limitation, your image and voice) for any purpose, commercial, advertising, or otherwise, and to prepare derivative works of, or incorporate into other works, such Contributions, and grant and authorize sublicenses of the foregoing.
We have the right, in our sole and absolute discretion, (1) to edit, redact, or otherwise change any Contributions; (2) to re-categorize any Contributions to place them in more appropriate locations in the App; and (3) to pre-screen or delete any Contributions at any time and for any reason, without notice. We have no obligation to monitor your Contributions.
There is ZERO TOLERANCE for objectionable content or abusive behavior on Autophone. By using the App, you agree that you will not create, upload, post, transmit, or share any Contribution that is unlawful, harassing, abusive, threatening, hateful, defamatory, obscene, pornographic, sexually explicit, or violent, or that promotes discrimination, self-harm, or illegal activity, and that you will not harass, threaten, or abuse other users.
To keep the community safe, we provide the following tools and commitments:
Your agreement to this zero-tolerance policy is a condition of using the App. Violation may result in immediate removal of content and termination of your account.
The App may include optional premium features available via a paid auto-renewable annual subscription ("AutoPRO"). Subscriptions are managed on our side through RevenueCat and processed by the app stores.
Unless otherwise indicated, the App is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the App (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of applicable jurisdictions and international conventions. Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to download, install, and use the App for your personal, non-commercial purposes.
We respect the intellectual property rights of others. If you believe that any Contribution or Content available in the App infringes a copyright or other intellectual property right you own or control, please send a notice to autophonedev@gmail.com including: (1) identification of the work claimed to be infringed; (2) identification of the material alleged to be infringing and its location in the App; (3) your contact information; (4) a statement that you have a good-faith belief that the use is not authorized by the rights holder, its agent, or the law; and (5) a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the rights holder or authorized to act on their behalf. We will review valid notices, remove infringing material where appropriate, and may terminate the accounts of repeat infringers.
When you access the App through the Apple App Store or Google Play Store, you acknowledge and agree that these Terms are concluded between you and us only, and not with Apple Inc. or Google LLC. We, not Apple or Google, are solely responsible for the App and the content thereof. These Terms incorporate, and are supplemented in the case of any conflict by, Apple's standard End User License Agreement (EULA), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.
THE APP IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE APP AND OUR SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE APP AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE APP'S CONTENT OR THE CONTENT OF ANY WEBSITES LINKED TO THE APP AND WE WILL ASSUME NO LIABILITY OR RESPONSIBILITY FOR ANY (1) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT AND MATERIALS, (2) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF THE APP, (3) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (4) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE APP, (5) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH THE APP BY ANY THIRD PARTY, AND/OR (6) ANY ERRORS OR OMISSIONS IN ANY CONTENT AND MATERIALS OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE APP.
IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING.
You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of: (1) your Contributions; (2) use of the App; (3) breach of these Terms; (4) any breach of your representations and warranties set forth in these Terms; (5) your violation of the rights of a third party, including but not limited to intellectual property rights; or (6) any overt harmful act toward any other user of the App with whom you connected via the App.
These Terms and your use of the App are governed by and construed in accordance with the applicable laws of the jurisdiction in which the developer resides, without regard to its conflict of law principles. Any legal action of whatever nature brought by either you or us shall be commenced or prosecuted in the competent courts of that jurisdiction, and the parties hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to venue and jurisdiction in such courts.
These Terms remain in full force and effect while you use the App.
These Terms and any policies or operating rules posted by us on the App constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision. These Terms operate to the fullest extent permissible by law. We may assign any or all of our rights and obligations to others at any time. We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control. If any provision or part of a provision of these Terms is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms and does not affect the validity and enforceability of any remaining provisions.
